By accessing the website at https://upturnapps.com, using our interactive Smart Project Estimator, or contacting our administration team, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Scope of Services

UpTurn Apps is a software development corporation specializing in custom web systems (Laravel, React), mobile applications (Flutter, Native iOS and Android), business analysis, and Agile project planning. Our online tools, including the project wizard, provide estimations and do not constitute binding commercial contracts or project plans until signed separately in a Master Services Agreement (MSA).

3. Use of the Project Wizard & Submissions

When you submit project requirements, feature choices, and contact details via our Smart Wizard or Contact Page:

You warrant that all information supplied is accurate and represents your own business idea or that you have authorization to submit it.
You retain all intellectual property rights to your product concepts and business models. UpTurn Apps will treat all submitted descriptions as confidential lead information.
You agree that the estimated budget, complexity indices, and timelines generated by the wizard are non-binding mathematical approximations for planning purposes only.

4. Intellectual Property

All content on this website, including but not limited to the UpTurn Apps logo, visual designs, design system code, stylesheets, Javascript files, and interactive wizard logic, is the property of UpTurn Apps and protected by applicable copyright, trademark, and intellectual property laws.

5. Limitation of Liability

In no event shall UpTurn Apps or its software engineers, project managers, or directors be liable for any damages (including, without limitation, damages for loss of data, profit, or business interruption) arising out of the use or inability to use the materials on our website, even if notified orally or in writing of the possibility of such damage.

6. Sprints & Development Delivery

Commercial software development project deliverables, bi-weekly reviews, and agile sprints are subject to individual Statement of Work (SOW) documents. Sprints schedules, story point planning, and change request procedures are established on a per-project basis.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of California, United States, and you submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute resolution.
